In a USTR notice made available on May 24, 2024, the USTR announced the fate of the 429 product-specific China 301 exclusions (352 previously reinstated exclusions and 77 COVID-related exclusions) which were scheduled to expire on May 31, 2024. Based on public comments received, the USTR determined to extend 164 of the exclusions through May 31, 2025. The remaining 265 exclusions will expire after a 14-day transition period extending through June 14, 2024.

In reviewing the USTR notice you will find the under Annex A and B (page 7) that USTR has granted extensions for all items that were originally excluded under provision 9903.88.67 and 9903.8868  through June 14th, 2024. (these were due to expire May 31,2024)

In this  USTR notice  under Annex C (page8) you will find the list of tariffs  that USTR has extended the exclusion period through May 31,2025

In addition, USTR Issues Report of its Four-Year Review of Actions Taken in the “China 301” Investigation; Proposes Additional Tariffs and Other Measures

Below is the list of the proposed actions.

The USTR will issue a Federal Register notice regarding this below list,  announcing the procedures for interested persons to comment on the proposed China 301 modifications, including information concerning an exclusion process for machinery used in domestic manufacturing.  It is expected that the Federal Register Notice will provide additional detail on the above proposals as well as timing. (this for the below list)

Lithium-ion electrical vehicle batteries  Increase rate to 25% in 2024

Medical gloves  Increase rate to 25% in 2026
Natural graphite  Increase rate to 25% in 2026
Other critical minerals  Increase rate to 25% in 2024
Permanent magnets  Increase rate to 25% in 2026
Semiconductors  Increase rate to 50% in 2025
Ship to shore cranes  Increase rate to 25% in 2024
Solar cells (whether or not assembled into modules)  Increase rate to 50% in 2024
Steel and aluminum products  Increase rate to 25% in 2024
Syringes and needles  Increase rate to 50% in 2024
